Terms Of Use This Website's Policy Regarding Terms of Use

Terms of Use

Effective Date: October 22, 2026

Agreement Between the User and Rubio Auto Body

This website is provided by Rubio Auto Body, an automotive collision repair and refinishing business serving Homestead, Florida. These Terms of Use govern access to the website and its online information, contact forms, estimate requests, appointment inquiries, and related features.

By using the website, you agree to these Terms of Use and acknowledge our Privacy Policy. If you do not agree, please discontinue use. Additional terms may apply to specific services, estimates, authorizations, or transactions.

Use of this website alone does not establish a repair contract, insurance agreement, warranty, or other service obligation. Any repair engagement is subject to separate confirmation and applicable written documents.

Eligibility and Intended Use

This website is intended for people seeking information about automotive body repair, collision repair, paint services, paint protection, vehicle restoration, insurance-related repair coordination, and related services.

Individuals under 18 should use the website with a parent or legal guardian. You agree to provide accurate information when submitting an inquiry.

Changes to These Terms

Rubio Auto Body may update these Terms of Use to reflect changes in its services, website features, business practices, or applicable law. The effective date above identifies the version posted. Updated terms apply to subsequent website use to the extent permitted by law.

Changes to these website terms do not automatically amend an existing signed repair authorization, invoice, warranty, or other separate agreement.

Website Information and Service Descriptions

Website content is intended for general information. Descriptions of services, techniques, materials, repair processes, timelines, and results are illustrative and may not apply to every vehicle or repair.

Photographs may depict examples of work or general automotive service activities. Actual repair methods and outcomes depend on inspection, damage, vehicle condition, parts availability, manufacturer procedures, and other circumstances.

We endeavor to keep information current but cannot promise that all website content will be complete, accurate, current, or error-free. Nothing on the website substitutes for an inspection or vehicle-specific written estimate.

Online Estimate and Quote Requests

Submitting an online estimate or quote request does not create a binding price, repair authorization, or guaranteed appointment. Information or photographs supplied online may not reveal hidden damage or all required repair operations.

Any preliminary estimate is subject to inspection, diagnostic findings, parts and labor requirements, applicable taxes and fees, and written confirmation. Supplemental damage or additional work may require a revised estimate and separate authorization as applicable.

You may request an estimate through our Auto Body Repair Quote page or call 305-777-9490.

Appointments, Scheduling, and Vehicle Drop-Off

Online requests for appointments, inspections, or repair scheduling are requests only until Rubio Auto Body confirms the time and arrangements. Availability may change due to workload, vehicle condition, parts delays, staffing, weather, or other operational factors.

Before delivering a vehicle, please confirm the appointment, drop-off instructions, transportation arrangements, and any documents or keys needed. If you must cancel or reschedule, contact the shop promptly.

Repair Authorization and Additional Work

No website submission by itself authorizes Rubio Auto Body to begin repairs or incur charges. Repair work, disassembly, diagnostics, supplements, parts ordering, and related services are subject to the applicable authorization and disclosures provided during the service process.

If inspection reveals additional damage or work not included in an initial estimate, Rubio Auto Body may seek approval before proceeding as required by applicable law and the governing repair documents.

Written repair orders, authorizations, estimates, invoices, and other service-specific documents control the scope, charges, and terms of the actual repair transaction.

Insurance Claims and Third-Party Payments

Rubio Auto Body may assist customers with repair documentation and communication involving insurers or claims representatives. Such assistance does not mean that Rubio Auto Body acts as an insurance company, insurance adjuster, attorney, or guarantor of coverage.

Coverage determinations, deductibles, claim approvals, reimbursement amounts, and payment timing are governed by the applicable insurance policy and the insurer’s decisions. The vehicle owner or other responsible party remains responsible for charges not paid by an insurer, subject to the applicable repair agreement and law.

An insurance estimate may differ from the final repair requirements. Any supplements, payment arrangements, or customer responsibilities should be reviewed in the applicable repair documents.

Parts, Materials, Paint, and Repair Methods

Repair recommendations may involve original equipment, aftermarket, recycled, reconditioned, or other replacement parts, depending on availability, insurer requirements, customer authorization, vehicle condition, and applicable law. The actual parts selected will be addressed in the applicable repair documents.

Paint matching and refinishing results can be affected by vehicle age, previous repairs, paint formulation, weathering, and substrate condition. Paint protection film and other protective treatments reduce certain risks but do not make a finish impervious to damage.

No website statement guarantees an exact color match, a particular repair method, the elimination of all imperfections, or a specific result in every circumstance. Any express service warranty must be stated in the applicable written warranty or repair documentation.

Pricing, Deposits, and Payments

Any website pricing or cost discussion is general and subject to change. Actual charges depend on the written estimate, authorized work, parts, labor, materials, taxes, fees, and any approved supplements.

Deposits, deductibles, payment methods, completion requirements, storage charges, and vehicle-release conditions, if applicable, will be addressed through the shop’s transaction-specific documents and applicable Florida law.

Payment is not considered completed until received and successfully processed. Third-party payment providers may impose separate terms.

Vehicle Condition, Personal Property, and Completion

Customers should disclose known pre-existing damage, mechanical or electrical issues, modifications, prior repairs, and other conditions relevant to safe inspection or repair. Please remove valuables and personal belongings before vehicle drop-off whenever practical.

Projected repair completion dates are estimates unless expressly confirmed otherwise in writing. Delays can arise from supplemental damage, parts supply, insurer review, manufacturer requirements, or circumstances outside the shop’s reasonable control.

Pickup, storage, release, and any post-repair concerns will be handled under the applicable repair documents and Florida law.

Electronic Forms and Communications

When you submit a website form, you authorize Rubio Auto Body and its service providers to receive, process, and respond to the information for the purpose of handling your request. An online submission is not automatically a legally binding electronic signature or repair authorization.

Rubio Auto Body may contact you about your estimate, appointment, vehicle, repair status, insurance coordination, or other requested service by telephone, email, or text, consistent with applicable law and the consent presented when you provide your information.

Where you separately consent to marketing communications, consent is not a condition of obtaining repair services. Message frequency may vary; message and data rates may apply. Reply STOP to opt out of text messages and HELP for assistance, where those features are supported. Marketing emails may include an unsubscribe mechanism.

Mobile contact information will not be shared with third parties or affiliates for their own marketing or promotional purposes. Information may be shared with communications providers supporting authorized customer-service and messaging operations.

Privacy and Data Security

Use of the website is also subject to our Privacy Policy, which explains how information may be collected, used, disclosed, and protected. Please do not submit unnecessary sensitive information through general contact or estimate forms.

Although reasonable measures may be used to protect website data, no internet transmission or electronic storage system can be guaranteed completely secure.

Acceptable Use of the Website

You agree not to use the website for illegal, fraudulent, deceptive, abusive, or disruptive purposes. In particular, you may not:

  • Submit false information or impersonate another person
  • Access information or systems without authorization
  • Introduce malware or attempt to bypass security controls
  • Scrape, harvest, or commercially republish site content without permission
  • Interfere with the availability or performance of the website
  • Infringe another person’s intellectual property, privacy, or other rights

Intellectual Property

Unless otherwise identified, the website’s original text, design, graphics, photographs, branding, and other content are owned by or licensed to Rubio Auto Body or its content providers and protected by applicable law.

Vehicle manufacturer names, logos, and marks remain the property of their respective owners. You may view or print reasonable portions for personal, noncommercial purposes, but may not reproduce or commercially exploit website content without permission.

Customer-Submitted Materials

If you submit vehicle photographs, descriptions, documents, reviews, or other material, you represent that you have the right to provide it and that doing so does not violate another person’s rights.

You grant Rubio Auto Body permission to use submitted materials as reasonably necessary to evaluate and respond to your request, coordinate requested services, document repair matters, and maintain relevant business records. Public marketing use of identifiable customer content will be subject to any separately required permission.

Third-Party Websites and Services

This website may link to maps, social media, payment services, insurance resources, messaging tools, or other independent third-party platforms. Those services may have their own terms and privacy policies.

Rubio Auto Body does not control and is not responsible for the content, availability, security, or privacy practices of independent third-party websites. A link does not necessarily imply endorsement.

Website Availability

Rubio Auto Body may change, restrict, suspend, or discontinue website features as needed. Access may be interrupted by maintenance, network outages, provider issues, security incidents, or other events. Continuous or error-free availability is not guaranteed.

Disclaimer of Website Warranties

Limitation of Liability

Indemnification

To the extent permitted by law, you agree to indemnify Rubio Auto Body against third-party claims and reasonable expenses arising from your unlawful use of the website, intentional misuse, infringement of others’ rights, or knowingly false or unauthorized submissions.

Access Restrictions and Termination

Rubio Auto Body may restrict website access when reasonably necessary to protect customers, personnel, systems, data, or legal rights. Provisions that by their nature should survive termination, including intellectual property, liability provisions, and governing law, remain effective as applicable.

Governing Law and Venue

These Terms of Use are governed by the laws of the State of Florida, without regard to conflict-of-law rules, to the extent permitted by applicable law.

For disputes specifically concerning website use, venue will be in a court of competent jurisdiction in Miami-Dade County, Florida, unless applicable law requires otherwise. Separate repair or service documents may provide additional applicable terms, subject to law.

Severability, Waiver, and Assignment

If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision does not waive future enforcement.

You may not assign rights under these website terms without written consent. Rubio Auto Body may transfer these terms in connection with a lawful transfer of website or business operations.

Entire Agreement and Order of Control

These Terms of Use and the Privacy Policy govern general website use. Where a separate signed repair authorization, estimate, invoice, written warranty, insurer document, or other transaction-specific agreement conflicts with general website statements, the applicable transaction-specific document controls for that transaction, subject to law.

No website description modifies a signed repair agreement unless the parties make an authorized modification.
